ELIGIBILITY: The Tennessee Department of Tourist Development Tennessee Music Holiday (referred to as “Promotion” or “Sweepstakes”) is open only to natural persons, i.e. not a corporation, who are current, legal residents of United Kingdom, who are over the age of eighteen (18) years old and possess a valid passport. Employees of the Tennessee Department of Tourist Development (“Sponsor” or “Released Party”), State of Tennessee departments and agencies and their respective subsidiaries, affiliates, Partner’s hosting the promotion, advertising and promotion agencies and immediate family members of, and/or those living in the same household of each, are not eligible to enter. The Sweepstakes is void outside the United Kingdom and where otherwise prohibited.
SWEEPSTAKES ENTRY PERIOD: The Sweepstakes begins June 4, 2018 12:00:00 AM BST – July 1, 2018 11:59:59 PM BST (“Sweepstakes Entry Period”). Sponsor's computer or that of a designated agent will be the official time keeping device for the Sweepstakes.
HOW TO ENTER: Online entry through the Tennessee Department of Tourist Development website. During the sweepstakes period, visit https://www.tnvacation.com/tnholiday then follow all entry instructions to complete the entry form and submit (the “Online Entry”). The Tennessee Department of Tourist Development also partnered with Spotify. Spotify will host the link, identified above, on their site at www.TNholiday.com.
Online entry is limited to one (1) per person.
If entering via a mobile phone or other web-enabled device and using your wireless carrier’s network, standard data charges from your wireless carrier may apply. All entries/materials submitted in connection with the Sweepstakes will become the property of Sponsors and will not be returned.
In the event of a dispute over the identity of an entrant, entry will be deemed submitted by the authorized account holder of the e-mail account of the e-mail address submitted at time of entry. The authorized account holder of the e-mail account is defined as the natural person who is assigned to the e-mail address by the Internet access provider, on-line service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Sponsor and its respective agents are not responsible for lost, late, damaged, misdirected, illegible, garbled, jumbled, corrupted, inaccessible or incomplete entries. The potential winner may be required to show proof of being the authorized account holder.
PRIVACY: Your privacy is important to the Tennessee Department of Tourist Development. Collecting personal information, here your name and email address, will only be used to notify the Potential Winner unless you indicated otherwise, by opting-in to the Tennessee Department of Tourist Development’s email subscription list on the landing page of the Promotion. If you did not choose to opt-in to receive continual information about the great state of Tennessee and its scenic beauty and musical heritage, your information will be removed from our database within a reasonable time following the identification and successful selection of a winner. If you did opt-in to receive great newsletters and ideas for trips that will last a lifetime, you can learn more about how your information is stored by viewing our Privacy Policy at https://www.tnvacation.com/privacy-policy. Additional information will be needed from the Potential Winner, in order to administer the prize, i.e. schedule flights, providing appropriate IRS tax forms, etc.

PRIZE/APPROXIMATE RETAIL VALUE (“ARV”)/ODDS: The prize winner will receive two (2) roundtrip airfares on British Airways for the winner and a guest to fly from London (Heathrow) to Nashville, TN (BNA). Four (4) night’s stay in Nashville, TN with Two (2) night’s stay in Memphis, TN, and Knoxville, TN. The prize may not be exchanged. Approximate retail value (“ARV”): $4200.00 – two (2) roundtrip airfares valued at $1500.00 each ($3000.00 total) and eight (8) nights’ hotel accommodations valued at $150.00 per night ($1200.00 total).
RANDOM DRAWING: A random drawing from all eligible entries received during the Sweepstakes Entry Period will be conducted to elect one (1) prize winner(s) (the “Potential Winner” and/or “Winner”). The drawing will be held on or around July 2, 2018 by the Tennessee Department of Tourist Development or a party acting on its behalf, whose decisions are final and binding in all matters relating to this Sweepstakes.
Odds of winning will depend upon the number of eligible entries received.
NOTIFICATION AND VERIFICATION: The Potential Winner will be notified via email and/or phone and will be required to sign and return, within three (3) days of notification, an Affidavit of Eligibility and Liability/Publicity Release (the “Affidavit”) along with IRS tax documents, where applicable. Noncompliance will result in disqualification and an alternate winner may be selected.
If a prize notification or prize is returned as undeliverable, or if Potential Winner is found to be ineligible, non-responsive or not in compliance with these rules that Potential Winner will be disqualified, and the prize may be awarded to an alternate Potential Winner in a separate random drawing. Two (2) or more alternate Potential Winners, as time allows, may be determined through this process, after which the prize may remain un-awarded.
PRIZE CONDITIONS:
Prize is not assignable or transferable although Sponsors reserve the right to substitute a prize of equal or greater value due to unavailability. Prize must be taken on dates specified by Sponsor or Prize will be forfeited in its entirety. Dates are subject to change by Sponsor only.
By participating and accepting a prize, winner represents that he/she understands that travel, whether by plane, automobile, or other conveyance, or by foot, and in the air, contains some inherent element of risk of accident, illness, injury, loss or death, which may be caused by negligence, forces of nature, or other agencies, known or unknown. By accepting a prize, winner acknowledges participation in the prize is voluntary, acknowledges that there are natural factors and occurrences which may impact on or affect the safety of the activities they are participating in and they assume the risk of such factors and occurrences and agree that the Released Parties will not be in any way responsible for any resulting injury and/or death.
TAXES AND EXPENSES:
The value of the prize stated above is based on available information provided to the Sponsor, and the value of prize awarded to Winner will be reported to the IRS and other authorities for tax purposes as required by law. Winner is solely responsible for reporting and paying any and all applicable taxes related to the Prize. All other expenses not specifically mentioned herein, including but not limited to tips, gratuities, incidentals, local and long distance telephone calls, and service charges, required transportation, any additional lodging beyond what is received through this Prize, all meals and beverages, and any other miscellaneous expenses not specifically mentioned above, are the sole responsibility of the Winner.
GOVERNING LAW/JURISDICTION: Except where prohibited, entrant agrees that any and all disputes, claims and causes of action arising out of, or connected with, the Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the state of Tennessee. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrant’s rights and obligations, or the rights and obligations of the Sponsor(s) in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the state of Tennessee without giving effect to any choice of law or conflict of law rules (whether of the State of Tennessee or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the state of Tennessee. The remedy for any claim shall be limited to actual damages, and in no event shall any party be entitled to recover punitive, exemplary, consequential, or incidental damages, including attorney’s fees or other such related costs of bringing a claim, or to rescind this agreement or seek injunctive or any other equitable relief.
THE PARTIES HEREBY WAIVE THEIR RIGHT TO JURY TRIAL WITH RESPECT TO ALL CLAIMS AND ISSUES ARISING OUT OF OR RELATING TO THIS AGREEMENT WHETHER SOUDING IN CONTRACT OR TORT, AND INCLUDING ANY CLAIM FOR FRAUDULENT INDUCEMENT THEREOF.
LIMITATION OF LIABILITY: The Released Parties, the State of Tennessee, each of their respective affiliates, subsidiaries, parent corporations, and their respective officers, directors, shareholders, employees and agents, are not responsible for: Any incorrect or inaccurate entry information, theft, tampering, destruction, or unauthorized access to, or alteration of entries; printing or other errors; and/or, any entries which are late, lost, delayed, incomplete, misdirected, stolen, mutilated, illegible, received with postage due or any combination thereof. Sponsors reserve the right to modify, suspend or terminate the Sweepstakes at any time that it may become necessary as a result of circumstances beyond the Sponsors’ control. In the event prizes are to be awarded when the Sweepstakes deadline date has lapsed, potential winner(s) will be selected from all eligible entries received as of the deadline date/time designated as the last day to enter the Sweepstakes.
RELEASE OF LIABILITY: By participating, winner(s), winners’ guests and entrants agree to release, discharge, indemnify and hold harmless the Released Parties from and against any claims made by a winner(s), a winner’s guest, entrants or any other third parties related in any way to the operation of this Sweepstakes as well as any other claims, damages or liability due to any injuries, damages or losses (whether alleged, threatened, or actual) to any person (including death) or property of any kind resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any prize or participation in the Sweepstakes and/or any Sweepstakes-related activity.
LEGAL WARNING: WITHOUT LIMITING THE FOREGOING, THE SWEEPSTAKES, ALL PRIZES, AND ALL MATERIALS PROVIDED ON OR THROUGH THE SWEEPSTAKES SITE ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. SOME JURISDICTIONS MAY NOT ALLOW LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES, SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. CHECK YOUR LOCAL LAWS FOR ANY RESTRICTIONS OR LIMITATIONS REGARDING THESE LIMITATIONS OR EXCLUSIONS.
ANY ATTEMPT BY YOU TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY’S FEES) FROM YOU TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.
CONDITIONS OF ENTRY: Entry materials that have been tampered with or altered are void. If, in the opinion of Sponsor(s) or party acting on its’ behalf, there is any suspected or actual evidence of electronic or non-electronic tampering with any portion of the Promotion, or if computer virus, bugs, unauthorized intervention, fraud, or technical difficulties or failures compromise or corrupt or affect the administration, integrity, security, fairness, or proper conduct of the Promotion, the judges reserve the right at their sole discretion to disqualify any individual who tampers with the entry process and void any entries submitted fraudulently, to modify or suspend the Promotion, or to terminate the Promotion and conduct a random drawing to award the prize using all eligible, non-suspect entries received as of the termination date. Should the Promotion be terminated prior to the stated expiration date, notice will be posted on the Website. In the event of a dispute as to the identity of the winner based on an e-mail address, the winning entry will be declared made by the authorized account holder of the e-mail address submitted at time of entry.
